The Fire (Scotland) Act 2005 - Part 3
The Fire (Scotland) Act 2005 and the Fire Safety (Scotland) Regulations 2006 have to complied with from the 1st October 2006.
This means you, the employer/owner has added responsibilites.
You must have a Fire Risk Assessment carried out and recorded if you have 5 or more persons employed.
Staff must be nominated and trained in fire fighting and evacuation procedures.
You must also have an Emergency Fire Action Plan in place.
With the removal of fire certificates and increased liability upon the owners and occupiers of businesses as the 'responsible person', Corporate Manslaughter is now a legal reality. As such, employers must ensure that their Fire Risk Assessments are conducted by legally competent personnel, otherwise they may feel the full force of the judical system.
